in Eduard Gans's Zusätze to Hegel's Elements of the Philosophy of Law - compiled from notes taken during Hegel's lectures - Hegel is attributed the thesis of the an sich indissolubility of marriage as an integral moment of the family, conceived as the root of the State. The ethical character of this dimension prevents marriage from being reduced to a merely legal relation. The dissolution of the marital bond thus appears as a contingent possibility which, however, cannot undermine its essential ethical identity.
