This contribution, which would try to reconstruct the thesis on the fallibility of the companies with a government participating interest, wonders whether it is topical such kind of debate at the light of the legislative output (Consolidated Law on companies with a government participating interest) and of the most recent sentences of legitimacy. The conclusion will be far from reassuring especially if we consider the attempts to propose, nevertheless the clear systematic indices, a different qualification of the “in providing company (according with its company form).
