Leonardo Sciascia e l’ombra dell’Inquisizione nella giustizia penale

In Leonardo Sciascia's literary production, the inquisition represents not only a key institution in the history of modern Europe, but also the profound memory of justice, a model of conformism, oppression, cynicism, from which we have never freed ourselves. The Sicilian novelist was convinced that the criminal trial was still burdened by its inquisitorial roots: both in the 'political' use of the jurisdiction, and in the abuse of vexatious and arbitrary procedural tools, which step away from the basic guarantees of the accused. Using a long-term historical-juridical perspective, this paper recomposes the many passages written by Sciascia like tiles in a coherent mosaic. These tiles reveal Sciascia's obsession with every past and present inquisition and nevertheless, dispite the underlying pessimism, they seek some glimmer of humanity.

Nella produzione letteraria di Leonardo Sciascia l’inquisizione rappresenta non solo un’istituzione-chiave nella storia dell’Europa moderna, ma anche la memoria profonda della giustizia, un modello di conformismo, sopraffazione, cinismo dal quale non ci si è mai affrancati. Lo scrittore siciliano era convinto che il processo penale fosse ancora gravato dall’ipoteca inquisitoria: sia nell’uso ‘politico’ della giurisdizione, sia nell’abuso di strumenti procedurali vessatori, arbitrari e tutt’altro che garantisti. Il saggio, privilegiando la prospettiva storico-giuridica di lungo periodo, ricompone come tessere d’un coerente mosaico i tanti brani scritti da Sciascia che rivelano l’ossessione per ogni inquisizione passata e presente e che tuttavia, pur nel pessimismo di fondo, ricercano qualche spiraglio di umanità.
