The article will focus on the need for a common European approach to regulate selfdriving vehicles and, in the same time, will explore alternative paths to third liability insurance taking into account that any choice can be ‘tragic’ and present critical profiles in relation to the interest to be pursued: protection of the injured party, promotion and increase of investments in AI, social well-being and reduction of insurance costs. Each solution implies a different set and balance of interests and values. And in this light, the article will explore advantages and drawbacks stemming from the so called pure no-fault insurance – which is a first part insurance – for self-driving vehicles as alternative to liability insurance (third party insurance).
