This essay focuses on the interconnections between the right to strike and the collective agreement, which represent the two "souls" of the trade union phenomenon: conflict and collective autonomy. After highlighting some theoretical problems relating to strikes and the limits imposed on them by contractual dynamics, the paper analyses collective bargaining practices in order to grasp the solutions concretely experimented by collective autonomy, with particular regard to the agreements stipulated in recent years in the industrial sector.
Il contributo ha ad oggetto le interconnessioni e le reciproche influenze che nel nostro ordinamento caratterizzano lo sciopero e il contratto collettivo e, quindi, il conflitto e l’autonomia collettiva: le due “anime” del fenomeno sindacale. La riflessione prende le mosse dai problemi teorici emersi nell’analisi dottrinale sullo sciopero e sui limiti ad esso imposti dalla dinamica contrattuale e prosegue attraverso l’analisi della prassi negoziale, al fine di comprendere le soluzioni concretamente sperimentate dall’autonomia collettiva, con attenzione particolare agli accordi stipulati negli ultimi anni nel settore industriale.
